Federal Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks lawful basis.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his return to the United States to answer alien smuggling allegations, he was detained in federal custody.
In her decision, the judge pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal challenge center on conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
